What Is Dram Shop Liability?

A “dram shop” is any establishment that serves alcohol, such as a bar, restaurant, or club. The term “dram” refers to a unit of measurement once used to measure alcohol.

The premise behind dram shop liability is that an intoxicated individual is not always solely responsible for his or her state of intoxication. Beginning in 1987, the state of Texas adopted laws stating that establishments that sold alcohol could be held at least partially responsible for the negligent acts of intoxicated patrons if they served those patrons alcohol once they were “obviously intoxicated.” In other words, these establishments have a duty to cut patrons off once the patrons exhibit clear signs of being intoxicated. If they continue to serve these patrons alcohol past this point, they can be held at least partially liable for damages if any injuries or deaths occur due to a DWI auto accident.

The operative term here is “partially liable.” Although the dram shop may share part of the fault for a patron’s intoxication, that does not absolve the patron of all blame. Indeed, in most cases in which dram shop liability comes into play, liability is shared between the drunk driver and the establishment that served him or her alcohol past the point of intoxication.
